INFORMATION ON THE PROCESSING OF PERSONAL DATA
Dear clients,
the aim of this document is to acquaint you with the basic principles of handling your personal data, which you provide to Kommand Team s.r.o., IČ 63978016, with headquarters behind Mototechna 1619/1, Prague 5, 15000.
The company perceives that the protection of natural persons in connection with the processing of personal data is their fundamental right. Following the above, the Company has adopted and consistently observes measures to protect your personal data so that they serve only the purpose for which you provided them to the Company. It ensures that there is no unauthorized access to your personal data, that it is not lost and that it is not misused in any way.
With this document, the company informs you about the extent and for what purpose your personal data is processed, who processes your personal data, to whom your personal data can be made available, what are the periods for their storage, what are your rights in connection with the processing of your personal data and whether automated processing, including profiling, takes place in connection with the processing of your personal data. In order for you to better navigate this document and make it pleasant for you as a client, we would like to explain some terms that appear in this document and which are not terms that you encounter in everyday life:
Personal data – is all information about an identified or identifiable natural person; an identifiable person is a natural person who can be directly or indirectly identified, in particular by reference to a certain characteristic, e.g. name and surname, social security number, residential address, IP address or to one or more special physical, physiological, genetic, psychological, economic, cultural or social identity of this natural person, e.g. phone number, e-mail address, age, personal status.
Processing of personal data – means an operation or a set of operations with personal data carried out with or without the help of automated procedures; this is the collection, recording, arrangement, structuring, storage, adaptation or alteration, retrieval, inspection, use, disclosure by transmission, dissemination, sequencing, restriction, erasure or destruction.
Personal data protection officer – is an entity with professional knowledge whose task is to monitor the compliance of personal data processing in accordance with the legislation, to carry out internal audits on the protection of personal data, to carry out training of personnel who work with personal data and to manage the management and processing agenda in general personal data.
- Legal basis for processing personal data
The legal basis for the protection of your personal data is given by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC, which with effect from 25/05/2018 it replaces Act No. 101/2000 Coll., on the protection of personal data. This regulation is also known by the abbreviation GDPR (General Data Protection Regulation) – General Regulation on the Protection of Personal Data and represents a new legal framework for the protection of personal data in the European area, i.e. it is also directly binding for the Czech Republic.
- Administrator of personal data
The administrator of your personal data is the Company. The company is not obliged to appoint a personal data protection officer, as its nature and activities, as the manager of your personal data, do not fulfill the characteristics defined by the General Regulation on the Protection of Personal Data.
- Purposes of personal data processing
The purpose of processing your personal data is related to the Company’s business, i.e. the implementation of a residential housing development project and the subsequent sale of individual residential and non-residential premises. The Company processes your personal data mainly for the purposes of concluding and managing the contract based on which real estate is purchased, as well as for the purposes of fulfilling contractual obligations resulting from it, as well as for the purposes of fulfilling obligations arising in particular from Act No. 256/2013 Coll., cadastral law and decree No. 357/2013 Coll., on the real estate cadastre. In these cases, your consent is not required for the processing of personal data.
- Scope of personal data processing
The company processes your personal data:
– e-mail adress
– telephone number
– address of permanent residence, or contact address,
– all first and last names
In the case of a natural person entrepreneur, the Company also processes his business name, distinguishing addendum or other designation, place of business, identification number.
- Sources of personal data
We obtain personal data exclusively from you, the clients, in connection with negotiations on the conclusion of a contract. We also obtain personal data from you during the duration of the contract, in the event that the personal data provided by you has changed and you fulfill an information obligation in relation to the Company.
- Period of storage of personal data
We store your personal data for the duration of the contractual relationship and for the period required and specified in the relevant legal regulations binding on the Company, e.g. in Act No. 499/2004 Coll., on archiving and file service.
- Disclosure of personal data to third parties
Your personal data may be made available without your consent:
- at the written request of public authorities, e.g. courts, law enforcement authorities, tax administrators, bailiffs, administrative authorities, etc., only to the extent and in accordance with generally binding legal regulations,
- to persons who, on the basis of the contract, participate in the subject of the Company’s activity, who are authorized to fulfill the Company’s contractual and legal obligations, all for the above-mentioned purposes of personal data processing,
Your personal data may be provided to other entities only with your express consent.
- Your rights related to the processing of personal data
You have the right to contact the Company at any time and request confirmation of the processing of your personal data. In addition to this right, you also have the right to correct your personal data if it is inaccurate or incomplete. In certain circumstances, you also have the right to be forgotten or, in other words, you have the right to have your personal data deleted, e.g. if your personal data are no longer needed for the purpose for which they were originally processed, or were processed unlawfully, or if the processing of your personal data was based on your consent and this has been revoked and there is no other legal reason for their processing. You also have the right to restrict the processing of your personal data, which you can exercise, for example, in the event that your personal data is processed unlawfully, but you refuse their deletion and instead request a restriction of their use, or you have raised an objection to the processing of your personal data . If your data is processed by automated means, you have the right to their portability. This right consists in the fact that you can request copies of your personal data from the Company in a common electronic format. The purpose is to enable the easy transfer of your personal data for the purpose of re-using them for your own use or for your own purposes in other services.
In the event that you do not get the opportunity to exercise any of your rights listed above, you have the right to object.
You can exercise the above rights in writing at the address of the Company’s registered office, i.e. Kommand Team s.r.o., IČ 63978016, located behind Mototechna 1619/1, Prague 5, 15000. Your signature must be officially verified on the application. You can also exercise your rights personally with any employee of the Company.
In the event that the Company violates its obligations when processing your personal data, you can file a complaint with the Office for Personal Data Protection.
- Profiling and automated decision-making when processing your personal data
The company does not use automated information systems and profiling within its processes, so no personal aspects of you are evaluated.
